1.2. You acknowledge that once you have legally purchased the software/ product which is the subject of this Agreement, any use or installation on computers or other devices are considered as implicit conduct as regards the user acceptance of the terms and conditions and render this Agreement legally binding.
1.3. This Agreement establishes no rights with respect to persons who acquire or utilize the service illegally or without authorization.
2.1. The product shall include the operating computer program, its complete documentation, and the database pertaining thereto and any content and third party services accessible through the X-Tag Database.
2.2 The product whether printed or electronic, or through images,storage, coding, source code and object and display modes, storage and encoding which can not be determined beforehand, along with all the corrections, additions and updates after the conclusion of this agreement used by the user, are considered as components of the product.
3.1. The Licensor - unless contractual or legal regulations state otherwise - is the exclusive owner of the copyright in all the materials and contents of X-Tag.
3.2. Copyright extends to any part of the product and its parts separately.
3.3. The user manual for X-Tag includes the menu option where all the owners of the Database items are listed. The Licensor hereby states that it has obtained sufficient usage and representation rights from the Database owners to use and permit the use of the database, as defined in this Agreement.
3.4. By concluding this Agreement, the Licensor shall withhold all rights vested in X-Tag, except those to which the User is entitled to according to this Agreement.
4.1. The User is entitled to install and use the product in a single device (beacon).
4.2. The User respects and accepts the product and / or its certain elements and / or contents provided by third parties may require separate action (registration / activation) within the time specified in the product to achieve a partial or full functionality.
5.1. Duplicate or copy the product (to make a copy from the same).
5.2. Translate the use of product platform (including translation and compilation to other programming languages).
5.3. Perform reverse engineering on the deviceor circumvent or obviate through technological or other me.
5.4. Modify, extend, or transform the product (in whole or in part), to separate it into parts, compose it with other products, install it in other products, even if it is compatible with other products.
5.5. In addition to using the computer program, to obtain database information included in the X-Tag platform, decompile the Database, to use, copy, modify, extend, transform the Database in whole or in part or the group of data there stored or install it in other products, utilize it in other products, even if it is to achieve compatibility with other products.
5.6. The User may only use the contents available through the platform provided by third parties and the data received through the services provided by third parties (including, but not limited to incoming traffic data from the RDS TMC traffic information service) for his personal benefit and their own risk.
6.1. The Licensor hereby informs the User that although great care was taken when creating the software, taking into account the nature of the product and the technical limitations, the Licensor cannot be held responsible for any error in the software, or errors which require action to be taken by the end user of the software.
6.2. The Licensor does not guarantee that X-Tag is suitable for any purpose defined either by the Licensor or the User, and does not guarantee that the product is compatible with any other system, device or product (eg software or hardware).
6.3. The Licensor does not assume any responsibility for any damage due to an error in the software (including errors in the computer program, the documentation or the Database).
6.4 The Licensor does not accept any Media that contains: indecent, obscene or pornographic material, hate speech, highly explosive subject matter (as determined by the Company), any illegal subject matter or activities or any other content that does not meet the Company’s quality standards as in effect from time to time (collectively referred to as the "Prohibited Content").
This includes: material that infringes the rights of others (including but not limited to copyright and other intellectual property rights) or which promotes copyright piracy (i.e., unauthorized MP3s, roms, 'warez', emulators, or cracks, etc.) Pornography, adult content, sexual or erotic material, gratuitous displays of violence, obscene or vulgar language, and abusive content or content which endorses or threatens physical harm. Promoting any type of hate-mongering (i.e., racial, political, ethnic, religious, gender-based, sexuality-based or personal, etc.) Any participation in or transmission of inappropriate newsgroup postings or unsolicited e-mail (spam). Promoting any type of illegal substance or activity (i.e., how to build a bomb, hacking, 'phreaking', etc.) Illegal, false or deceptive investment advice and any type of content reasonable public consensus deems to be improper or inappropriate.
7.1. The Licensor hereby informs the User that, if this agreement is breached, the Licensor may:
7.2. Instigate legal proceedings in respect of the violation of this agreement for which costs will be sought.
7.3. Require the cessation of the infringement by the user, and compensation for the breach.
8.1. The Licensor hereby excludes any liability for its database and for any content or service provided by a third party using the database. The Licensor does not warrant as to the quality, suitability, accuracy and information delivery capacity or service availability, and specifically excludes any responsibility for the suspension of the service and any damage that may arise related to the service or for complete cancellation of the service.
8.2. The Licensor or a contractual partner may offer various products and services to the User through the X-TAG website. The User may only use these services after having read and understood the end user license agreement. This License allows you to use X-Tag in one single beacon by obtaining credits.
8.3. This Agreement establishes no rights with respect to persons who unlawfully acquire, or use the product without having a legal basis for it.
